Having the conversation about your Will and/or Estate Planning  doesn’t need to be complicated, nor do you need to know ahead of time what your wishes are. Will Writing associates will talk you through every decision that needs to be made and give you plenty of time to think things through to make sure that you’re happy with your last wishes.

What you need to know

Here are some frequently asked questions relating to wills.

Having a will is important because it makes sure your belongings go to the people you choose after you die. If you don’t have a will, the law decides who gets what, and this might not match what you wanted. This could leave out people who are important to you, like a partner you’re not married to or close friends. A will also makes things easier and less stressful for your family when dealing with your estate after you pass away.

Straightforward and explained every step of the way. You’ll have an initial appointment so that the Will Writer can fully understand your situation, you’ll be taken through which decisions need to be made and you may be offered recommendations or suggestions where appropriate. The aim is to get everything done and dusted within this appointment and you’ll receive your Will within a week or so of approving your Drafts. Sometimes a second appointment will be required to give you time to think and/or gather the information needed to finalise things.

If you marry, divorce or have children you should check or amend your Will.  The aim should always try to “futureproof” your Will as far as possible against these things with you so that amendments are less frequent and therefore less costly.

There are several types of Trust that can be arranged alongside your Will, all with a different purpose. You can protect against potentially vulnerable children or other beneficiaries inheriting directly with the use of a Trust,  or place your home or other asserts into Trust to prevent “sideways disinheritance” (if your spouse remarries after your death, you could risk your children not inheriting) among other things.
